Maryland Judge Politicizes Justice to Justify Unjust Sentence
Anne Arundel County Circuit Court Judge Laura Kiessling consulted her political agenda to determine the sentence for an illegal immigrant, Martin Martinez-Ballinas, who killed Marine Lance Corporal James Ray Walden III when he lost control of his BMW 335i while speeding around a corner. Martinez-Ballinas struck Walden’s motorcycle sending him into the woods that line the side of the road where he eventually landed 36 feet from the road; Walden needed immediate help. Martinez-Ballinas didn’t stick around to locate and render aid to Walden; he fled on foot until he was found by a police helicopter and police canine approximately half a mile away crouched between stacks of concrete pallets; a textbook case of a hit and run that demands justice.
Kiessling doesn’t view Martinez-Ballinas’s decision to drive his vehicle 65 mph in a 35 mph zone and fleeing the scene after killing Walden deserving of a lengthy prison sentence because he was under political duress. During sentencing, Kiessling claimed she received many letters from people who are concerned about the “current political climate” created by President Trump because he is “harshly critical of illegal immigration and Mexico in particular.” Kiessling said it is “reasonable to conclude” that the threat of deportation motivated Martinez-Ballinas to flee the scene; the Trump administration’s enforcement of U.S. immigration laws is to blame for Martinez-Ballinas’s cowardly act. Kiessling prefaced her sentence for Martinez-Ballinas by stating, “I’m not going to sentence based on the political environment,” then handed down a sentence of six years in prison, a sentence the State’s attorney called a “cowardly act.” The judge politicized justice by declaring innocence where there is guilt and arbitrarily deciding that leniency is appropriate for a person who commits vehicular manslaughter if that person happens to be an illegal immigrant.
Kiessling removed the blindfold from Lady Justice and placed her hands on the scale when she meted out justice based on her political beliefs. Lady Justice symbolizes the fair and equal administration of the law, without consideration of race, color, creed, religion, wealth, or station in life. Justice doesn’t care about the reason Martinez-Ballinas fled the scene of his crime; justice is blind.
